Laura Prepon and Ben Foster accuse each other of 'cruel and inhuman treatment' in ongoing divorce


More than six months after their separation, Laura Prepon and husband Ben Foster’s divorce proceedings are far from over. 

Last Tuesday, Foster, 44, filed an amended divorce petition in Nashville, Tenn., that updates his grounds for divorce from Prepon, 45, to include “inappropriate marital conduct” alongside the previously stated “irreconcilable differences.” The complaint, which was obtained by Entertainment Weekly, claims that Prepon’s alleged conduct — which is described as “cruel and inhuman treatment” — “renders further cohabitation [with her] unsafe and improper.”

Prepon responded to Foster’s claims in her own filing just one day later, which saw her levy the same allegation against him and similarly accuse him of being “guilty of such cruel and inhuman treatment” during their marriage. In the complaint, which was also obtained by EW, the That ‘70s Show actress also denied being guilty of “inappropriate marital conduct” and demanded “strict proof” to back up Foster’s claim. 

Prepon’s legal team confirmed the lawsuit to EW but provided no additional comment. In their own statement, Foster’s lawyers Rose Palermo and Caroline Altshuler told EW, “This is simply the standard procedure for divorce cases in Tennessee since we are not a no fault state.”

The Orange Is the New Black star accused her ex of “inappropriate marital conduct” and further alleged that the Inferno actor was “guilty of habitual drunkenness” throughout their six-year marriage. 

In his complaint, Foster requested that he and Prepon both be awarded joint custody of their two children, noting that they were both “fit and proper parents.” However, in her response, Prepon denied that they were both “fit and proper parents to be awarded the joint care, custody, and control of the parties’ minor children and demands strict proof thereof.”

Instead, the actress requested to be “designated the primary residential parent of the parties’ minor children,” which she claims is “in the children’s best interests.”

Prepon and Foster were friends for years before they began dating in July 2016. The couple got engaged three months later, after welcoming their first child in 2017, and officially tied the knot in June 2018. 

“Just Married!” Prepon captioned an Instagram post that featured the pair on their wedding day. “Thank you for all the love and support. Wishing all of us the good stuff!”

The couple welcomed a second child in 2020 and were together for another four years before officially separating on Sept. 9, 2024.
